This page will be replaced with a reviewed version before this goes any further.
What you're agreeing to
By using Lately, you agree to these terms and to the practices described on the Privacy page.
18 and older
Lately is an 18+ product. Creating an account requires confirming you're 18 or older, and an age-range cohort is collected at signup for that purpose (see Privacy for what that's used for and how it's handled). If we discover an account belongs to someone under 18, we will remove it.
Invite-only
Creating an account requires a code from an existing member — there is no public sign-up. An invite code is meant for the specific person it's shared with, not for public or bulk distribution, and we may deactivate a code or account used that way.
The waitlist
Submitting your email address on latelylist.com is a request to be told when Lately opens. It is not an account, not a place in the test, and not a commitment on our part to invite you. Joining still requires a code from an existing member. See the Privacy page for what happens to that address.
Your content
Item names, notes, the categories you file things under, any photo you attach to an item, any daily photo you post — even though it isn't attached to an item at all — any caption you add to a daily photo, and any ask or reply you write are your own content, shown to other people in your test group because that's the point of the app. By adding content, you give Lately a limited, non-exclusive licence to store, host, and display it to the other participants it's meant for — nothing more. That licence ends when you delete the content or your account, per the retention terms on the Privacy page. You're responsible for what you add — don't attach or write anything you don't have the right to share.
Acceptable use
Don't use Lately to harass or impersonate another participant, misrepresent yourself, or try to access an account or data that isn't yours. We can suspend or terminate an account for violating this, or for any other reason, at our discretion — this is a small closed test, not a public service with a formal appeals process.
This is a prototype
Lately is an evaluation build, not a finished product. Features may change, break, or be removed without notice. The service may be discontinued at any time, including before the test period ends. Data may be lost. There is no uptime commitment of any kind.
This is also a research study
This isn't only a product test — it's a research study, and the plain version of that sentence is the point of writing it here. By participating, your usage is being observed to evaluate whether the product works the way it's meant to. You can stop using Lately, or delete your account, at any time, for any reason, with no obligation to explain why.
Two classifications are recorded about you as part of this research and are never shown to you: which cluster you've been placed in, and whether you're recorded as geographically scattered from or local to your friend group. Neither is something you provide or choose. Separately, the person running this test keeps a private log of any direct outreach they do to you about it. All three exist — this section names them; the Privacy page describes what they are and how they're used.
Account deletion
You can delete your account at any time from the You tab, after a confirmation step naming exactly what's removed. See the Privacy page for the full retention position.
Product information isn't guaranteed
Prices, availability, and other product details come from what participants enter and from third-party catalogs (Open Library, Google Books, and Apple's podcast directory) — Lately doesn't verify any of it. Treat anything you see about a product as a starting point, not a guarantee; it may be wrong, outdated, or no longer accurate by the time you see it.
Outbound links
A link to buy a product takes you to the merchant that sells it. That link is not an endorsement by Lately, and Lately is not a party to anything you buy — the transaction is between you and the merchant.
Lately earns no commission from any purchase today. Outbound links exist only so a click can be logged (see Privacy) and so you can reach the merchant — no affiliate program is connected, and none has been applied for. If that ever changes, it will carry whatever disclosure the FTC requires for that kind of relationship, and it will be disclosed on the item itself, before it happens — not only on this page.
Nobody is paid to be here
No participant is paid, given credit, or compensated in any way for adding something to Lately or for recommending it to a friend. No brand can pay to appear anywhere in the app, and nothing is ranked by what it might earn — items surface because more of your friends have them and kept them.
If any part of that changes, it will be disclosed in the app before it takes effect, not only on this page.
Blocking
Blocking another participant removes your friendship with them in both directions and removes you both from any group you currently share. This cannot be undone from within the app. If you block someone by mistake and want it reversed, contact us (below) and we'll do it by hand.
Liability, governing law, and changes to these terms
To the fullest extent the law allows, Lately and the person operating it aren't liable for damages or losses arising from your use of this prototype — this is a test run among friends, not a commercial service with the guarantees one would come with.
These terms are proposed to be governed by the laws of Ontario, Canada, where the operator is based. Needs counsel: every participant in this test is based in the US, and a US consumer's home-state consumer-protection law may not actually yield to a foreign choice-of-law clause like this one. This is proposed, not settled, and shouldn't be relied on as a resolved legal position.
If these terms change in any meaningful way, we'll update the date at the top of this page and let you know inside the app — not bury the change somewhere nobody re-reads.
